DMCA Copyright Policy

1. Copyright Compliance

FireBrief LLC ("FireBrief") respects the intellectual property rights of others and expects users of our Service to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our Service.

This DMCA Policy describes the procedures for submitting copyright infringement notifications and counter-notifications.

3. Filing a DMCA Takedown Notice

If you believe that content available through FireBrief infringes your copyright, you may submit a notification pursuant to the DMCA by providing our Copyright Agent with the following information in writing:

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or if multiple works, a representative list of such works.
  2. Identification of the infringing material: Identification of the material that you claim is infringing and that is to be removed or disabled, including the URL or other specific location where the material appears. Please provide sufficient detail for us to locate the material.
  3. Your contact information: Your name, address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
  6. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

I have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.

4. Upon Receipt of a Valid DMCA Notice

When we receive a valid DMCA takedown notice, we will:

If you believe that your content was wrongfully removed due to a mistake or misidentification, you may submit a counter-notification to our Copyright Agent with the following information:

  1. Identification of removed material: Identification of the material that has been removed and the location where it appeared before removal.
  2. Your contact information: Your name, address, telephone number, and email address.
  3. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or King County, Washington if you are outside the United States), and that you will accept service of process from the party who provided the original DMCA notification.
  4. Good faith statement: A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  5. Signature: Your physical or electronic signature.

FireBrief maintains a policy for the termination, in appropriate circumstances, of users who are repeat infringers. We may terminate access for users who repeatedly submit content that infringes the copyrights of others.

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
